#Michael Cohen’s attorneys to argue for his release later this week

Lawyers for President Trump’s former fixer Michael Cohen will argue for his release in a Manhattan federal court hearing later this week, according to court papers filed Tuesday.

The attorneys for Cohen will appear Thursday morning to argue for a temporary restraining order that could spring the convicted felon from Otisville prison and send him back into home confinement, according to the court filing.

The hearing will be the first in Cohen’s suit filed Monday against Attorney General William Barr, the Bureau of Prisons and the warden of Otisville.

In the suit, Cohen claims he was locked up last week because he refused to agree to not publish a tell-all book that would accuse Trump of being “a cheat, a liar, a con man, a racist,” the suit said.

“While on furlough [from prison], Mr. Cohen repeatedly made public his intention to publish his book about President Trump soon,” Cohen’s attorneys wrote in the suit.

“On July 2, 2020, he tweeted that he was putting the finishing touches on what promised to be a tell-all book about his experience with Mr. Trump.”

“Just one week later, on July 9, 2020, US Probation Officers, working on behalf of the [Bureau of Prisons], presented Mr. Cohen with an unconstitutional demand: As a condition of his release — a release BOP already had determined was necessary to protect Mr. Cohen’s health — he had to agree to a complete bar on speaking to or through any media of any sort, including via a book.”

Cohen said “he did not refuse,” but sought clarification on the limitations.

The former Trump fixer was sentenced to three years in prison in 2018 for tax evasion, bank fraud and lying to Congress, but was released on furlough in May after one year due to the coronavirus outbreak in Otisville.

Cohen was taken back into custody on July 9 after he was caught by a Post photographer eating at a Manhattan restaurant.
