#What happens if a president is not elected by Inauguration Day?

Inauguration Day is more than two months away — but what would happen if a president still hasn’t been elected by then?

In the most unlikely of scenarios, the House speaker — currently Rep. Nancy Pelosi — would become president.

But there’s a lot that would need to happen before America would ever get there.

The states’ electoral votes are cast on Dec. 14 — and the candidate who gets at least 270 of the 538 wins.

However, if there is no clear winner in the Electoral College, the 12th Amendment dictates that the House of Representatives would elect the president and the Senate would pick the vice president.

The Congress that enters in January would be responsible for the so-called “contingent election.”

In this process, the House would have to choose between the top three candidates with the most electoral votes — or in this case, just President Trump and Joe Biden.

Each state delegation would get one vote, with 26 needed to declare a winner.

Only one previous president has been named under the 12th amendment — John Quincy Adams in 1825.

For the VP slot, the Senate would need to pick between the top two vice-presidential candidates with the most electoral votes — Mike Pence and Kamala Harris.

Each senator gets a vote, with 51 votes required to win.

If the House fails to elect a president by the time Jan. 20 (Inauguration Day), rolls around, then the vice president-elect chosen by the Senate serves as acting president until the deadlock is resolved in the House, according to the national archives.

If that still fails, then the 20th Amendment takes over — making the vice president-elect acting president until a president has qualified.

In the unlikely event that neither the president-elect nor the vice president-elect are chosen by Jan. 20, then the Presidential Succession Act applies.

This would make the speaker of the House, Pelosi, president until both chambers of Congress decide on someone.
