The Santa Barbara District Attorney, Joyce Dudley, also announced that the deputies were justified in their actions and will not face charges.
The verdict comes nearly a year after police shot Cameron Ely to death, at the scene where the 30-year-old killed his mother, 62-year-old Valerie Lundeen, just moments before, USA Today reports.
In a report compiled by the DA’s office, investigators concluded that deputies shot Ely because he seemed threatening, and failed to comply with orders to stay on the ground — jumping up suddenly while saying, “I have a gun.”
According to the report, all four deputies told the investigator they heard the utterance “clear as day.”
After examining Cameron Ely, police found an iPhone, paper, car key fob and other items — but no gun.
“When (Cameron) disobeyed verbal commands by deputies, sprang to his feet and moved his hands to his waistband as if grabbing a weapon while saying, ‘I have a gun!’ shortly after killing his mother, his actions created a reasonable fear of death or great bodily injury in the minds [of the four deputies],” the report states.
“Each of the deputies acted reasonably in his/her use of deadly force; therefore, the shooting of Cameron Pierce Ely is a justifiable homicide.”
Ron Ely and his two daughters have filed a wrongful death suit against the Sanat Barbra Sheriff’s department for leaving Valerie to bleed out after Cameron attacked her.
As of Tuesday, no official court date has been scheduled.
