A retired FDNY lieutenant was fatally shot during an argument with a homeowner outside of his upstate New York residence on Saturday, authorities said.

The former firefighter, Scott Kempler, 50, of Patterson, was among two shooting victims found outside the home of 43-year-old Stephen Swanton in the town of Webb in Herkimer County, according to state police and the FDNY.

The other victim, 55-year-old William Robertello, of Oriskany, was treated and released from a nearby hospital, authorities said.

Swanton, the suspected gunman, was arrested at the scene and charged with murder.

Kempler and Robertello had been feuding with the Swanton earlier in the day at a nearby house party. The argument then spilled over to the suspect’s house, authorities said.

At his arraignment, Swanton was remanded to Herkimer County Jail.
