A Virginia rapper who took his album cover at the January 6 capitol riot was sentenced to five months in prison on Monday (December 19), WUSA9 reports. Antionne Brodnax a.k.a. Bugzie The Don pleaded guilty to four misdemeanor charges in October 2021 after rejecting a previous plea deal of one count.

Brodnax can be seen on the cover for his album The Capital — the spelling may or may not be intentional — smoking on top of an SUV. Brodnax also reportedly entered the Capitol building the same day.

Prosecutors asked the court for 21 months due to his criminal record. The Justice Department agreed, claiming that Brodnax deleted pictures and videos from his phone after promising to turn them over to investigators. Mary Maguire, Brodnax’s attorney, hailed her client as an “entrepreneur” and “great community asset” due to his ownership of a record label and clothing line.

U.S. District Judge Paul Friedman noted Brodnax’s criminal history on sentencing, which included probation for a separate offense when he was at the Capitol on January 6. “He’s had a problem historically with following conditions imposed upon him,” Friedman said.
