“NY Democrats won’t boot GOP Assemblyman Lester Chang”

Democrats controlling the New York Assembly will not seek to overturn the result of a Brooklyn race that saw a Republican oust a veteran legislator over a residency snafu.

Lester Chang will keep the seat for which he was just sworn in this week after Democrats raised questions about whether he established a legal residency to Brooklyn in time before the November election.

“After careful review, the vast majority of our members have significant concerns about the truthfulness of Mr. Chang’s documentary evidence and testimony regarding his compliance with the New York State Constitution,” Speaker Carl Heastie said in a statement released late Friday afternoon.

“Although it is clear that there were more than enough votes to expel Mr. Chang, we will not do so at this time,” the leader said.

Assembly Democrats will introduce a “legislative remedy” to make sure future candidates run with less confusion over where they legally live, he added.

Asian Americans have expressed outrage at the possibility of Chang getting booted from representing District 49 covering parts of Bay Ridge, Dykers Heights and Bensonhurst following his narrow win over entrenched Democratic Assemblyman Peter Abbate, Jr.

“My Brooklyn neighbors desperately need relief from New York’s high crime rates, exorbitant cost of living, and nation-leading taxes,” Chang said in a statement about responding to community concerns.

“I will also lead the fight in Albany for merit-based public school opportunities for hardworking students,” he added in an apparent reference to years-long fights over changing admission requirements to specialized high schools in New York City.

Many Democrats were concerned about the political blowback to ousting Chang among Asian Americans, a group that has veered rightwards in recent elections.

Heastie ordered the Assembly Judiciary Committee to probe whether Change met the one-year residency requirement to run against Abbate in Kings County where his mother has lived for years.

Chang has maintained he too has lived their as his legal residence despite voting in Manhattan in 2021 and previously running for office there. 

The committee report, prepared by election lawyer and longtime Heastie associate Stanley Schlein, was released on Dec. 31 ahead of Chang officially beginning his term the following day.

“At most, it can be stated that Mr. Chang’s nexus to the Kings County address during the applicable time period was one of a visitor.”

But a significant chunk of Assembly Democrats ended up pushing the conference as a whole away from the idea of making Chang the first person in a century to be expelled from the chamber.  

“It’s hard not to seat someone when a good portion of the conference doesn’t agree,” one Democratic member of the chamber told The Post on Thursday.

While Chang is keeping his seat “at this time,” he is not legally in the clear quite yet, according to Heastie, who said “relevant criminal, civil and administrative authorities” will review potential legal violations.

“This includes the unrefuted evidence related to Mr. Chang’s Manhattan rent-regulated apartment and the government subsidies he accessed,” Heastie said.
