#Ice cream truck keeps plowing into NYC street barrier

I scream, you scream — we all scream when this truck comes down the block.

A scofflaw ice cream truck driver has made a twice-daily ritual out of plowing through the wooden barriers meant to cordon off a brownstone Brooklyn street so kids can play, neighbors say — spurring an investigation by the NYPD.

Video shot by local parent Dan Starobin shows the truck entering westbound into Pacific Street in Boerum Hill on three separate occasions this week alone — 2:30 p.m. and 6:05 p.m. Monday and 2 p.m. Tuesday — though the dad says it has been going on for more than a month.

Each time, the truck rolls right over the police barricades at Bond Street that are supposed to stop vehicles entering the street so that locals can enjoy the space as part of the city’s “open streets” program.

“I first caught him about six to eight weeks ago. I chased him down on my skateboard to see what his response was,” said Starobin, 38. “When I asked him what he was doing, he just laughed.”

“He’s been confronted by many people, and his response is always laughter. Everybody is all over this guy, and he just doesn’t care.”

Nevins Street resident Lee McCormick, 43, said she’d seen the shards of broken barricades.

“That is scary to hear,” McCormick said of the driver’s actions. “There are a lot of kids playing in the street here. There is also a rehab center.”

Confronted a Post reporter Wednesday, the truck’s 27-year-old driver claimed he was not the barricade buster, but rather it was a “lazy” 21-year-old employee.

“I’ve been having the complaints, so I kicked him out. I don’t know what you’re talking about,” said the driver, Gary, who refused to give his last name and insisted it was “too hot to wear a mask” as he dished scoops out to neighborhood kids.

The driver nevertheless argued the open street was a nuisance that “doesn’t make sense.”

“Maybe it was too hot and he didn’t want to get out the truck. He is lazy. He is a kid. He is just 21. He might be lazy and in a bad mood,” he said.

Starobin, however, insisted the man driving the truck on Wednesday was the same person plowing over the barricades.

He said he was contacted by the local precinct after NBC New York ran a story about the menace.

An NYPD spokesperson confirmed the department had received complaints of leaving the scene and criminal mischief related to the ice cream truck.
