#Thomas Valva’s mom files $200M suit over his freezing death

The mother of Thomas Valva filed a $200 million federal lawsuit Tuesday, claiming Long Island courts, school officials and social service agencies failed to protect the boy from his abusive ex-NYPD cop dad before the youngster froze to death in January.

Justyna Zubko-Valva claims in court papers that her autistic 8-year-old son was subjected to years of “completely preventable” abuse at the hands of his cop dad, Michael Valva, and his girlfriend, Angela Pollina — while officials continually looked the other way, her lawyers said in a release.

“Ms. Zubko-Valva had provided evidence to the court, CPS, the police and the children’s (Family Court) attorneys several times that showed the severe physical, mental, and sexual abuse of her children by Valva and Pollina,” the release said.

“Rather than taking action to protect the children and stop their abuse by their father and his fiancee, and report the multiple complaints of abuse that had been made, as required under New York State Social Services Law, defendants hid the truth about the children’s health and fabricated false, misleading and dishonest reports about Ms. Zubko-Valva and her children.”

Michael Valva, 40, a 15-year NYPD veteran, is awaiting trial on murder charges in his son’s Jan. 17 death from extreme hypothermia. Prosecutors said the boy died after the ex-cop locked him in the garage of his Suffolk County home overnight amid freezing temperatures.

Valva was given custody of his three children with Zubko-Valva despite her repeated complaints that the kids were being abused.

“The children frequently arrived at school with urine-soaked clothes and wearing diapers — having bathroom accidents and not being able to control their bowel movements — despite having been potty trained years before,” the claims say. “Despite all of the red flags and warning signs, nothing was done and the mistreatment of the children continued.”

“This case is horrific and tragic,” Jon Norinsberg, Kubko-Valva’s lawyer, said in a statement. “(Michael) Valva was protected because he was a police officer. If he had been a normal citizen, he would have been arrested and put in jail.”

“But because he was a police officer, the defendants looked the other way and let him get away with this horrific abuse,” he said. “Little Tommy would still be alive if these defendants had done their jobs properly.”

The lawsuit names Suffolk County Child Protective Services and several supervisors, the East Moriches Union Free School District and officials there, the Suffolk County Attorney’s Office, and Nassau County Supreme Court Justice Hope Schwartz Zimmerman, who gave custody of the children to Michael Valva.

A spokesman for the New York State Office of Court Administration declined to comment on the claims against Zimmerman, telling The Post that the office does not comment on pending litigation.

Attorneys for Michael Valva and Pollina, Suffolk County officials and officials at the East Moriches school district could not immediately be reached for comment.
