#Supreme Court upholds order blocking Keystone XL pipeline

The US Supreme Court denied a request from the Trump administration to allow construction of the Keystone XL pipeline by upholding a lower court’s ruling blocking a permit needed for the project to proceed.

The court, in an unsigned brief on Monday, said the pipeline must follow a thorough environmental review process.

The justices did not provide a reasoning for the decision.

Environmental groups challenged the permit program outlined by the Clean Water Act for projects passing over bodies of water.

Federal Judge Brian Morris in Montana agreed with the groups that a US Army Corps of Engineers permit would allow companies to skirt responsibility for damage done to rivers and streams.

Morris’ decision dealt a blow to Canadian-based TC Energy that needed the permit to build the controversial pipeline to carry crude oil to Nebraska.

From there, it would connect with another existing network to deliver the oil to refineries in Texas along the Gulf of Mexico.

TC Energy spokesman Terry Cunha said the decision would delay the Keystone project but the company will continue to work on a section in Canada as it continues the legal fight.

The Obama administration twice rejected the pipeline project because of pressure from environmental groups.

President Trump in January 2017 signed an executive order allowing Keystone to proceed.
