The charge of felony battery by strangulation against Florida singer and rapper Rodarius Marcell Green (Rod Wave) has been dropped, Pitchfork reports and a court document reviewed by The FADER confirms. Green was arrested on May 2 after an altercation with his ex-girlfriend. “From the investigation which has been made, it is the opinion of the writer that this case is not suitable for prosecution,” an Osceola County state attorney explains in the filing.

In a verbal statement by Green’s ex-girlfriend paraphrased in the warrant for Green’s arrest (also reviewed by The FADER), she told a deputy sheriff that Green had “put his hands around her neck choking her to where she couldn’t breathe” while “accusing her of talking to other men.”

“This case was a misunderstanding between a Girlfriend and Boyfriend,” Green’s attorney Bradford Cohen wrote in a prepared statement to The FADER. “That misunderstanding resulted in Mr. Green’s arrest. After review of the evidence and speaking with witnesses, the State entered a Nolle Pross/ No Info on the matter and will not be pursuing charges. We thank the Osceola County State Attorney’s Office for their professionalism.”
