Det. Joseph Nicolosi was patrolling June 1 when he saw Rivera allegedly inside a Fifth Avenue CVS that was closed amid widespread looting, according to the suit filed Saturday.
When Nicolosi attempted to stop Rivera, the suspect allegedly resisted arrest and assaulted Nicolosi, according to the suit.
Nicolosi suffered cuts and bruises and a sprained knee, the suit claims. He was taken to Bellevue Hospital.
The monetary damages are to be determined, according to the lawsuit.
Rivera was given a Desk Appearance Ticket for resisting arrest and trespassing but not assault, police said. The case is pending.
The Detectives Endowment Association union plans to help any of its members who are assaulted seek relief in court.
“We are encouraging our detectives if they are assaulted to make us aware and we will pursue criminal charges as well as civil action,” DEA President Paul DiGiacomo said. “Hopefully, legal action will cause some of the criminals to think twice before assaulting one of our detectives.”
