#NJ corrections officer who had sex with locked-up ex gets probation

A former New Jersey corrections officer who admitted getting intimate in a jail bathroom with a locked-up ex lover was sentenced to two years of probation, prosecutors said.

Thomas J. Mauro, a 42-year-old former guard at the Monmouth County Correctional Institution, was sentenced Tuesday by a judge who disagreed with the state’s request for the Beachwood man to spend 180 days in jail, Monmouth County Prosecutor Christopher Gramiccioni said.

Instead, a judge decided on probation for Mauro, but added he would serve 180 days behind bars if he violates the conditions of that agreement. Mauro was also ordered to maintain full-time employment, get substance abuse treatment and undergo mental health evaluations, Gramiccioni said.

Mauro, who pleaded guilty in May to criminal sexual contact, also forfeited his ability to hold public office ever again.

Prosecutors said a 31-year-old female inmate from Neptune City entered a bathroom at the Freehold Township lockup in April 2019. Moments later, Mauro followed her into the bathroom, which was reserved for the exclusive use of jail staffers, and the pair engaged in sex acts before leaving the restroom separately.

A subsequent investigation revealed that Mauro and the woman had a relationship in 2013, prior to her incarceration.

But regardless of their past, sexual contact with an inmate is prohibited by law, prosecutors said.

“Law enforcement officers have an obligation to maintain the public’s trust that they are conducting themselves at the highest standards,” Gramiccioni said. “Corrections officers have the added obligation to ensure that they are maintaining an environment free of the abuse demonstrated in this case.”

Mauro, who worked at the jail for 13 years, had earned $106,000 prior to forfeiting his employment when he pleaded guilty earlier this year. He had faced up to six months in jail, NJ.com reported in May.
