Alexander John Feaster, 45 — who struck 26-year-old Kyndal McVey with a hail of bullets as she fled in June — claims she put him in “imminent danger of death or great bodily harm,” according to the Smoking Gun, which cited court papers.
McVey was at a party across the street from Feaster’s house around 3 a.m. June 28 when someone dared her to yank down one of his two Nazi flags, according to local police.
As she bolted back to the party, someone yelled “Gun!” — and Feaster opened fire with his AR-15 rifle, striking her several times in the lower abdomen and legs.
She was hospitalized for several weeks but survived, and Feaster was charged with assault and battery with a deadly weapon.
While arguing this week that his $500,000 bail should be reduced, Feaster claimed he’s a “patriotic citizen” and “loyal American” whose political beliefs made him a victim of harassment.
He insisted he was a victim of a hate crime, and that McVey should have been charged with larceny and trespassing.
But investigators say the Nazi enthusiast had been waiting for someone to try to steal his flags.
They say his own security system recorded him shooting McVey while she was “obviously running away from his residence with only a flag in her hand,” according to the outlet.
