#Black men sue Walmart, claim they were handcuffed after trying to return defective TV

Two black men — one a former police officer and the other a church pastor — have sued Walmart, saying they were discriminated against at a Texas store and falsely imprisoned after trying to return a defective television.

The plaintiffs, Dennis Stewart, 55, and Terence Richardson, 53, said in the suit that an unnamed white Walmart employee in the Houston suburb of Conroe, Texas, called the cops on them when they tried to return the TV in September.

The suit, which was filed in the US District Court for the Southern District of Texas, says Stewart presented the receipt for the TV, but the employee who was working at the customer service counter insisted they had stolen the TV.

“The police showed up, detained, and handcuffed both Dennis and Terence in front of
the store where other store customers looked on as they entered and exited the store,” the suit alleges.

“The indignity to Plaintiffs did not stop there, they were next paraded in front of the store, taken and held in the Loss Prevention Office where they pled and asked for the Loss Prevention Officer (‘LPO’) to look at the Walmart receipt which proved the television had been purchased,” it goes on.

The suit notes that Stewart began to “cry and begged for answers.”

The men were eventually released, the suit says, but the store managers made them “sign a paper requiring them never to return to the store or they would be arrested, and the store still refused to honor the agreement to accept the returned television.”

“Now, Walmart has created a false record implying Plaintiffs are thieves and unwelcomed customers,” the suit says.

The two men were then told to leave the store with the defective TV they had hoped to return, the suit says.

The episode has caused “tremendous pain, embarrassment and mental anguish,” according to the suit.

Randy Hargrove, a Walmart spokesman, said in a statement that the allegations were brought to the company’s attention in April and that Walmart investigated them.

“We do not tolerate discrimination and take allegations like this seriously,” he said. “We are not getting into further detail given the litigation and will respond as appropriate with the court.”
