#Ana De Armas Fans Sue Universal Due Over Actress Being Cut Out of Yesterday

Two Ana De Armas fans filed a federal class-action lawsuit against Universal because they claimed the actress was not in the final cut of the movie Yesterday, although the actress appeared in the trailer. The film hit theaters in June 2019 and grossed $154 million globally. Conor Woulfe, 38 and Peter Michael Rosza, 44, say they each paid $3.99 to rent the movie on Amazon Prime, only to discover that De Armas was removed from the film’s final cut.

The suit accuses Universal of engaging in deceptive marketing techniques by adding De Armas in the trailer and having her in the list of the cast of the film. In addition, it also accuses Universal of false advertisement, unjust enrichment, and violating competition laws, among other claims. The lawsuit seeks to recover at least $5 million on behalf of affected consumers who’ve seen the movie.

“Because consumers were promised a movie with Ana De Armas by the trailer for ‘Yesterday,’ but did not receive a movie with any appearance of Ana De Armas at all, such consumers were not provided with any value for their rental or purchase,” the lawsuit states.

Yesterday stars Himesh Patel (Don’t Look Up, Tenet) as Jack Malik, a singer who, through a supernatural occurrence, is the only person on Earth who remembers the Beatles. Malik then claims credit for the band’s songs, essentially gaining stardom. De Armas was to appear as Malik’s love interest, Roxane, who’s introduced to him on the set of James Corden’s talk show. Malik was to serenade her with a rendition of George Harrison’s song Something, but unfortunately, the scenes with De Armas’ character were removed.


“That was a very traumatic cut because she was brilliant in it. I mean really radiant,” screenwriter Richard Curtis previously stated. “You know, it’s one of those things where it’s some of our favorite scenes from the film, but we had to cut them for the sake of the whole.”

Furthermore, Curtis explained that viewers did not like the idea of Malik straying from his primary love interest in the film, who is portrayed by Lily James.

“Unable to rely on fame of the actors playing Jack Malik or Ellie to maximize ticket and movie sales and rentals, Defendant consequently used Ms. De Armas’s fame, radiance and brilliance to promote the film by including her scenes in the movie trailers advertising Yesterday,” the lawsuit reads.

Woulfe and Rosza are represented by attorney Cody R. Lejeune.

Universal declined to comment.
